Acceptable Use Policy

The rules that apply when you use our services, platforms, hosting and applications.

1. Introduction

1.1 This Acceptable Use Policy sets out the rules that apply when clients, users, employees, contractors, suppliers, or any authorised third party use services provided by Ongoti Tech Solutions (Pty) Ltd.

1.2 Our services may include software development, website development, mobile application development, web hosting, cloud support, domain-related services, system maintenance, application support, database support, digital consulting, and other related information technology services.

1.3 The purpose of this Policy is to protect our systems, clients, users, infrastructure, reputation, and service availability. It also helps ensure that our services are used lawfully, responsibly, and securely.

2. Agreement to this Policy

2.1 By using our services, platforms, websites, applications, hosting environments, cloud environments, support systems, or any digital solution provided or managed by Ongoti Tech Solutions, you agree to comply with this Acceptable Use Policy.

2.2 If you do not comply with this Policy, we may take appropriate action. This may include issuing a warning, restricting access, suspending services, removing content, terminating services, reporting unlawful activity, or taking any other lawful steps available to us.

2.3 This Policy must be read together with any service agreement, quotation, service level agreement, privacy policy, hosting terms, support agreement, or other terms agreed between you and Ongoti Tech Solutions.

3. Lawful use of services

3.1 You may only use our services for lawful purposes.

3.2 You may not use our services to commit, assist, encourage, enable, conceal, or promote any criminal, illegal, unlawful, fraudulent, harmful, abusive, or unauthorised activity.

3.3 You remain responsible for all activity carried out through your account, website, application, hosting space, system access, user credentials, or digital environment.

4. Unacceptable use

You may not use our services for any of the following:

4.1 Any activity that breaches South African law or any applicable international law.

4.2 Any activity that infringes the rights of Ongoti Tech Solutions, our clients, users, service providers, or any third party.

4.3 Any activity that violates intellectual property rights, including copyright, trade marks, patents, trade secrets, confidential information, source code ownership, software licensing terms, or proprietary business information.

4.4 Any activity that interferes with, disrupts, damages, overloads, or degrades our systems, infrastructure, hosting environments, applications, networks, databases, servers, or service delivery.

4.5 Any unauthorised access, attempted access, scanning, probing, penetration, testing, bypassing, or interference with systems, networks, accounts, applications, databases, APIs, security controls, or authentication mechanisms.

4.6 Any attempt to introduce, upload, distribute, execute, or transmit malware, ransomware, viruses, worms, trojans, spyware, bots, malicious scripts, backdoors, or harmful code.

4.7 Any use of our services to send spam, unsolicited bulk messages, unlawful direct marketing, phishing messages, fraudulent communication, spoofed messages, or misleading electronic communication.

4.8 Any activity that impersonates another person, business, organisation, public body, employee, supplier, or user.

4.9 Any use of false, misleading, inaccurate, or fraudulent information when registering for, accessing, or using our services.

4.10 Any activity that compromises personal information, confidential information, access credentials, client data, project files, business records, payment information, or system security.

4.11 Any use of our services to host, store, publish, transmit, or distribute unlawful, defamatory, abusive, threatening, discriminatory, obscene, harmful, exploitative, or otherwise prohibited content.

4.12 Any activity that promotes violence, hate speech, harassment, intimidation, exploitation, discrimination, or unlawful conduct.

4.13 Any use of our hosting, software, or application services for cryptocurrency mining, botnets, denial-of-service attacks, automated abuse, scraping without permission, credential harvesting, or similar abusive conduct.

4.14 Any use that places unreasonable load on our infrastructure or third-party infrastructure used to deliver our services.

4.15 Any breach of a service agreement, software licence, hosting arrangement, privacy policy, security policy, support agreement, or other applicable terms.

5. Software development and application use

5.1 Where we develop, configure, support, or maintain software for you, you must ensure that the system is used only for its agreed and lawful purpose.

5.2 You may not use software, websites, mobile applications, dashboards, portals, APIs, databases, or automations developed or supported by us in a manner that is unlawful, unsafe, abusive, deceptive, or inconsistent with the agreed project scope.

5.3 You may not reverse engineer, copy, resell, sublicense, modify, or redistribute our proprietary software, source code, templates, workflows, documentation, design assets, or configurations unless expressly agreed in writing.

5.4 You must not remove copyright notices, ownership notices, technical controls, access restrictions, audit logs, or security features from any solution developed or supplied by us.

6. Hosting and cloud services

6.1 Where we provide, manage, support, or facilitate hosting or cloud services, you are responsible for the content, data, users, accounts, and activity associated with your hosted environment.

6.2 You must not use hosted environments to store, process, or distribute unlawful material or to conduct harmful activity.

6.3 You must not overload, abuse, or misuse hosting resources, including storage, bandwidth, CPU, memory, database connections, email sending limits, API limits, or other allocated resources.

6.4 We may apply technical controls to protect service stability, including rate limits, traffic filtering, account restrictions, temporary suspension, malware removal, or other reasonable security measures.

6.5 Where a third-party hosting provider, cloud platform, registrar, email provider, or infrastructure provider has its own acceptable use rules, those rules will also apply.

7. Email, messaging, and communication services

7.1 You may not use any email, messaging, notification, or communication service provided or supported by us to send unlawful, unsolicited, deceptive, abusive, or harmful communication.

7.2 You may not send bulk communication unless you have the required consent or lawful basis and have complied with applicable direct marketing laws.

7.3 You may not use our systems to send phishing emails, spoofed emails, fraudulent invoices, fake notices, malware links, or messages designed to mislead recipients.

7.4 We may restrict or suspend email-related functionality where there is evidence of spam, abuse, compromise, blacklisting risk, or unlawful communication.

8. Security obligations

8.1 You must take reasonable steps to protect your account, system access, devices, users, passwords, API keys, access tokens, hosting credentials, administrator accounts, and confidential information.

8.2 You must use strong passwords and must not share access credentials with unauthorised persons.

8.3 You must notify us as soon as reasonably possible if you suspect unauthorised access, account compromise, malware, data leakage, phishing, system abuse, or any other security incident involving our services.

8.4 You may not attempt to bypass security controls, disable monitoring tools, interfere with audit logs, or conceal unauthorised activity.

9. Client data and personal information

9.1 You may not use our services in a manner that unlawfully collects, processes, stores, shares, sells, exposes, or compromises personal information.

9.2 Where you provide personal information to us or upload it into a system developed, hosted, or supported by us, you are responsible for ensuring that the information has been collected and provided lawfully.

9.3 You must not upload or process sensitive personal information unless it is necessary, lawful, authorised, and protected by appropriate safeguards.

9.4 Any use of our services must comply with applicable privacy and data protection laws, including the Protection of Personal Information Act, where applicable.

10. Monitoring and enforcement

10.1 We may monitor service usage, logs, access records, security alerts, infrastructure performance, support activity, and system events where reasonably necessary to protect our services, clients, users, and infrastructure.

10.2 Monitoring may be used to identify misuse, investigate complaints, respond to security incidents, maintain service quality, enforce this Policy, and comply with lawful obligations.

10.3 We will act proportionately and will not unnecessarily interfere with legitimate use of our services.

11. Suspension, restriction, or termination

11.1 We may suspend, restrict, remove, or terminate access to services if we reasonably believe that:

  • a. this Policy has been breached;
  • b. unlawful activity is taking place;
  • c. service stability or security is at risk;
  • d. third-party infrastructure or service providers require action;
  • e. personal information, confidential information, or client systems are at risk;
  • f. payment, contractual, or service obligations have been breached; or
  • g. urgent action is required to protect Ongoti Tech Solutions, our clients, users, systems, or the public.

11.2 Where practical, we will notify the affected client before taking action. However, we may act immediately where urgent intervention is required.

11.3 Suspension or restriction does not remove your responsibility to pay any fees due under an applicable agreement.

12. Reporting unacceptable use

12.1 Any suspected breach of this Acceptable Use Policy should be reported to:

12.2 Reports should include, where available:

  • a. the nature of the suspected abuse;
  • b. the relevant website, application, domain, IP address, email address, user account, or system involved;
  • c. date and time of the incident;
  • d. screenshots, logs, messages, or other supporting evidence; and
  • e. contact details of the person submitting the report.

12.3 We will review reports and take appropriate action based on the nature, seriousness, and evidence of the matter.

13. Cooperation with authorities

13.1 We may cooperate with regulators, law enforcement agencies, courts, internet service providers, hosting providers, domain registrars, cybersecurity bodies, or other lawful authorities where required or permitted by law.

13.2 We may disclose information where legally required, where necessary to protect our rights or systems, or where necessary to prevent harm, fraud, abuse, cybercrime, or unlawful activity.

14. Third-party services

14.1 Some services may depend on third-party platforms, hosting providers, cloud providers, software vendors, payment providers, email providers, domain registrars, analytics services, or security tools.

14.2 You must comply with the acceptable use rules, terms, policies, and restrictions of those third parties where they apply to the service being used.

14.3 We are not responsible for any suspension, restriction, or enforcement action taken by a third-party provider as a result of your conduct or content.

15. Changes to this Policy

15.1 We may update this Acceptable Use Policy from time to time to reflect changes in our services, legal obligations, operational requirements, security risks, or third-party provider requirements.

15.2 Where material changes are made, we will take reasonable steps to notify affected clients. This may include email notification, publication on our website, updated contractual documents, or another reasonable method.

15.3 Continued use of our services after changes have been communicated or published will constitute acceptance of the updated Policy.
