Fair Use Policy

What fair and reasonable use of our shared services means, and how we manage excessive use.

1. Purpose

This Fair Use Policy explains what reasonable and fair use of our services means, and how Ongoti Tech Solutions manages situations where use of a service is excessive, abnormal or affects other customers. It supports a stable, secure and high-quality service for everyone.

2. Scope

This Policy applies to all services provided or managed by the company, including web hosting, cloud support, email, domains, software platforms, applications and related technology services. It must be read together with our Acceptable Use Policy and Standard Terms and Conditions.

3. What fair use means

Many of our services rely on shared infrastructure and finite resources such as storage, bandwidth, processing capacity, memory, database connections and email-sending capacity. Fair use means using these resources in a reasonable manner that is consistent with the service you have taken up and that does not unfairly affect other customers or the stability of our infrastructure.

4. Service and resource limits

Where a service has a defined bandwidth allowance, usage limit, resource allocation or service level, that information is set out in the applicable Pricing and Service Disclosure, quotation, product schedule or service agreement. You should review the disclosure for your service to understand the limits that apply to you.

5. Use that may breach fair use

The following are examples of use that may be unfair or abnormal and may trigger action under this Policy:

  • sustained or excessive consumption of bandwidth, storage, CPU, memory or database resources beyond the allocation for your service;
  • activity that degrades performance, stability or availability for other customers or for our infrastructure;
  • using a shared hosting environment to run high-load, always-on or resource-intensive processes that are not appropriate for that environment;
  • sending bulk or high-volume email in a manner that risks blacklisting, abuse complaints or harm to mail services;
  • using a service in a way that is materially inconsistent with the purpose for which it was provided.

6. How we manage excessive or abnormal use

Where we identify use that may breach this Policy, we will act reasonably and proportionately. Depending on the situation, we may contact you to discuss the usage, request that the usage be reduced, apply technical controls such as rate limiting or traffic shaping, recommend a more suitable service or package, or apply the suspension and restriction provisions of the Acceptable Use Policy and Standard Terms and Conditions.

Where practical, we will notify you before taking action. However, we may act immediately where urgent intervention is required to protect service stability, security or other customers.

7. Hosting resources

For hosting and cloud services, you are responsible for the content, applications, data and activity within your environment, and for keeping resource use within the allocation for your service. We may apply reasonable security and stability measures, including malware removal, resource limits, account restrictions or temporary suspension, as set out in the Acceptable Use Policy.

8. Relationship to other policies

This Fair Use Policy supplements, and does not replace, our Acceptable Use Policy, Standard Terms and Conditions and Privacy Policy. Where a signed service agreement, product schedule or disclosure sets out specific limits, those terms apply to that service.

9. Changes to this Policy

We may update this Fair Use Policy from time to time to reflect changes in our services, infrastructure, legal obligations or operational requirements. Material changes will be published on this website or communicated through appropriate channels.
