Standard Terms and Conditions
The standard terms that govern services we provide, unless a signed agreement says otherwise.
1. Scope
These Standard Terms and Conditions apply to services provided by oNgoti Tech Solutions unless replaced or varied by a signed service agreement, quotation, order form, product schedule or statement of work.
2. Service descriptions
Service descriptions, prices, payment terms, service levels, contract terms, limitations, restrictions, fair usage terms and material conditions must be communicated to customers before service commencement.
3. Customer obligations
The customer must provide accurate information, pay all charges when due, use services lawfully, comply with the Acceptable Use Policy and Fair Use Policy, maintain reasonable security and cooperate with reasonable technical, compliance or abuse investigations.
4. Pricing and payment
Prices, once-off fees, recurring charges, installation fees, usage-based charges, out-of-bundle charges and taxes must be stated in the applicable quotation, invoice, service schedule or published pricing information. Payment must be made by the due date stated on the invoice or agreement.
5. Service levels
oNgoti Tech Solutions will only offer service levels that are reasonably within its technical and practical abilities. Service levels, support hours, response targets and exclusions must be stated in the relevant product or service schedule where applicable.
6. Hosted content and takedown
Where the company hosts, stores or transmits customer content, the company may remove, disable access to, suspend or restrict any content that it reasonably considers illegal, unlawful, harmful, abusive or subject to a valid takedown notice.
7. Suspension and termination
The company may suspend, restrict or terminate services where the customer breaches these terms, fails to pay, breaches the Acceptable Use Policy or Fair Use Policy, creates security or operational risk, provides false information, engages in unlawful conduct or causes the company to breach legal or contractual obligations.
8. Complaints
Customer complaints may be submitted to complaints@ongotitech.co.za. Complaints will be recorded, assessed and managed through the Complaints Handling Procedure.
9. Privacy
Personal information will be processed in accordance with the Privacy Policy and applicable law.
10. Limitation of liability
To the extent permitted by law, oNgoti Tech Solutions will not be liable for indirect, consequential or special loss, loss of profit, loss of data, business interruption or harm caused by customer misuse, third-party networks or events outside reasonable control.
11. Amendments
These terms may be updated from time to time. Material changes will be published or communicated through appropriate channels.
